I imagine that it'll sort of take the same process as gay marriage has in the states. We've already seen two states (Washington and Colorado) legalize it. My guess is that as the movement continues to progress, more states will suddenly start legalizing it, and eventually the federal government will make a decision. With gay marriage, it's expected that the Supreme Court is goign to "review its constitutionality" in April, which basically means we're likely to see federal legalization very soon.
